    當事人對行政機關作出的行政處罰等決定，在法定期限內不申請行政復議或不提起訴訟又不履行時，行政機關申請人民法院強制執行的案件，由人民法院依法對案件所涉具體行政行為的合法性進行審查，并就是否準予強制執行作出裁定。
